Legal terminology for co-owners of real estate is either co-tenants or joint tenants, with the latter phrase signifying a right of survivorship. Most common law jurisdictions recognize tenancies in common and joint tenancies. Many jurisdictions also recognize tenancies by the entirety, which is effectively a joint tenancy between married persons. To form a tenancy by the entirety, the parties must be married, the husband and wife must acquire the property at the same time, title to the property must be granted by the same instrument, the husband and wife must have identical interests in the property and both parties must have equal rights to possession of the property. Tenancy by the entirety is a type of shared ownership of property recognized in most states, available only to married couples. Much like in a joint tenancy, spouses who own property as tenants by the entirety each own an undivided interest in the property, each has full rights to occupy and use it and has a right of survivorship. A Tenancy by the Entirety allows spouses to own property together as a single legal entity.

If the couple divorces, the property is converted to a tenancy in common.
